Introduction
These are the terms and conditions on which Handicaddie Ltd (company no. NI670943) (hereinafter "Handicaddie", "we", or "us") makes the Platform and Application available to you. Handicaddie Limited provides an online platform that enables associated Golf Clubs to coordinate and book Caddies to provide caddying services to Golfers (the "Platform"). The Platform is accessible and available on the Handicaddie mobile application (the "Application").
By using the Platform via the Application, you agree to comply with and be legally bound by the terms and conditions set out herein (the "Terms"). While we use all reasonable endeavours to ensure uninterrupted performance of the Application, we make no warranties or representations as to its function without fault.
Definitions
The following definitions and rules of interpretation apply in these Terms:
- "Applicable Law" means all applicable laws, statutes, regulations from time to time in force;
- "Data Protection Legislation" means all applicable data protection and privacy legislation in force from time to time in the UK including the Data Protection Act 2018 and UK General Data Protection Regulation;
- "Golfer(s)" means those golfers wishing to have a Caddie booked for them by a Golf Club and to whom the caddying services will be provided;
- "Golf Club(s)" means the golf clubs affiliated with Handicaddie from time to time, as listed on the Platform;
- "Credits" means the digital credits purchased by Caddies to qualify for booking opportunities at participating Golf Clubs;
- "Writing" When we use the words "writing" or "written" in these terms, this includes emails.
Caddie Terms and Conditions
1. How the Platform Works for Caddies
The Application will be used by Caddies to set up a caddie profile (the "Caddie Profile"), which shall be available to view by Golf Clubs wishing to book a Caddie to provide caddying services at their Golf Club.
A Caddie wishing to use the Platform to advertise their availability to provide caddying services must first register as a "caddie" on the Application and set up their Caddie Profile.
Please note: Caddies must be at least 13 years old to register a Caddie Profile with Handicaddie.
2. Caddie Profile and Responsibilities
The information disclosed within the Caddie Profile is based entirely on the information submitted by the Caddie. It is the responsibility of the Caddie to ensure the information supplied is accurate, complete and correct. You will indemnify and hold harmless Handicaddie for any inaccuracies or misrepresentations made by you on your Caddie Profile.
The Caddie undertakes that they shall comply with all Applicable Laws when using the Platform and Application and when providing any caddying services. You further undertake to provide any caddying services with all due care, skill and ability.
The Caddie registers as a caddie with Handicaddie, creates a Caddie Profile and uses the Platform and Application entirely at their own risk and nothing in these Terms shall render the Caddie an employee, worker, agent, consultant or partner of Handicaddie. The use of the Platform and Application by the Caddie will not constitute a contract of employment and accordingly the Caddie shall be fully responsible for any income tax, National Insurance and social security contributions arising from their use of the Platform.
Similarly, use of the Application does not make the Caddie an employee, worker, agent, consultant or partner of any Golf Club. The relationship between the Caddie and the Golf Club is solely between those two parties. Handicaddie is not involved in or liable for the relationship between Caddies and Golf Clubs, including but not limited to any employment matters, disputes, or obligations that may arise.
3. Bookings and Cancellations
Caddies are advised to keep their availability up to date at all times via the Application. The schedule of when jobs are available is determined between the Golf Club and the Caddies. Handicaddie is not responsible for notifying Caddies when they should set their availability.
When a caddie booking opportunity arises, the Golf Club will select and request Caddies for specific Golfers/tee times ("Booking"). Handicaddie is not involved in the selection of Caddies. Once a request is sent by the Golf Club, the Caddie will receive notification via the Application and has the choice to accept or deny the caddie request.
For the avoidance of any doubt, Handicaddie shall have no liability to Caddies regarding the selection process or where they have not been selected for a Booking.
Golf Clubs and/or Golfers may cancel or change their Booking(s) from time to time, in which case affected Caddies will be notified by Handicaddie via email and notification on the Application. Handicaddie shall not have any liability for any losses or damages suffered by the Caddie as a result of cancellation/change by the Golf Club or Golfer.
Caddies shall be permitted to cancel any Booking at any time prior to the tee off time by contacting the Golf Club directly. Should Caddies cancel their Booking, they shall indemnify Handicaddie in respect of any losses or damages which may be suffered as a result of the cancellation.
Golfer Terms and Conditions
1. How the Platform Works for Golfers
The Platform enables Golfers to book Caddies through their affiliated Golf Club. Golfers may request caddie services directly through the Application or their Golf Club may arrange caddie services on their behalf.
2. Golfer Account and Registration
Golfers may be required to create an account on the Platform to access certain features. When creating an account, you agree to provide accurate, current, and complete information and to maintain and update this information as necessary.
3. Caddie Bookings
Golfers may request caddie services for their rounds of golf. Handicaddie and/or the Golf Club will endeavour to fulfil these requests subject to caddie availability. Handicaddie makes no guarantee that a Caddie will be available for any particular booking.
Golfers acknowledge that Caddies are independent contractors and not employees of Handicaddie. Handicaddie is not responsible for the acts, omissions, or conduct of any Caddie.
4. Golfer Responsibilities
Golfers agree to:
- Treat Caddies with respect and professionalism
- Provide timely notification of any booking changes or cancellations
- Pay the agreed caddie fee as specified by the Golf Club
- Comply with all Golf Club rules and regulations
- Use the Platform in accordance with these Terms
5. Cancellations and Changes
Golfers may cancel or modify their caddie booking in accordance with the Golf Club's cancellation policy. Late cancellations or no-shows may result in fees or restrictions on future bookings at the Golf Club's discretion.
Payment and Credit Terms
1. Caddie Credit System
Certain Golf Clubs utilize a credit-based system for caddie bookings. At these participating clubs, Caddies must purchase and maintain a credit balance to qualify for booking opportunities.
Important terms regarding Credits:
- Credits are non-refundable once purchased
- Credits are used to secure booking opportunities at participating Golf Clubs
- The credit system is enabled at the Golf Club's discretion - not all clubs use this system
- Credit requirements and pricing are set by individual Golf Clubs
- Credits have no cash value and cannot be transferred or exchanged
- Handicaddie reserves the right to modify credit pricing with reasonable notice
2. Cashless Payments
Golfers may pay for caddie services directly through the Platform using our cashless payment system. All cashless payments are processed securely through Stripe, our third-party payment processor.
For Golfers:
- Payments are processed securely through Stripe
- You will pay the full caddie fee plus an additional service fee to complete the cashless payment transaction
- Payment confirmation will be sent via the Application
- Refunds for cancelled services are subject to the Golf Club's cancellation policy
For Caddies:
- To receive cashless payments, Caddies must set up their payout account through the Platform during onboarding
- When a Golfer pays via the Platform, you will receive the full caddie fee - Handicaddie covers the transaction processing fees
- Payments will be transferred to the bank account you selected during onboarding
- Funds will be available in your account according to Stripe's standard payout timeline and terms of service
- Handicaddie is not responsible for delays or issues related to Stripe's payment processing
- You are responsible for any taxes or reporting requirements related to income received through the Platform
3. Payment Processing
All payments on the Platform, including credit purchases and cashless caddie payments, are processed by Stripe. By using our payment services, you agree to be bound by Stripe's Services Agreement and Privacy Policy. Handicaddie does not store or have access to your complete payment card details.
Handicaddie reserves the right to modify payment processing methods, providers, or fees with reasonable notice to users.
4. Platform Fees
Handicaddie may charge platform fees for certain services. Any applicable fees will be clearly disclosed before you complete a transaction. Golf Clubs may also set their own fees for caddie services, which will be communicated through the Platform.
General Terms
Our Rights to Make Changes
We may change:
- Any aspect of the Platform, a Booking and/or the Application to reflect changes in relevant laws and regulatory requirements and/or to implement minor technical adjustments and improvements
- The scope of the Platform and/or the Application from time to time at our discretion by notice in writing to you
- These Terms from time to time at our discretion by notice in writing to you
Termination
We may, in our absolute discretion, terminate these Terms with you and/or any Booking at any time by giving notice in writing to you. We may also deactivate your profile and registration with Handicaddie at our discretion.
Liability and Indemnification
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, or for fraud or fraudulent misrepresentation.
Subject to the above, we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, in respect of any loss or damage you may incur as a result of your use of the Platform and/or the Application.
Data Protection
Your privacy and personal data are important to us. We will only use your personal information as set out in our Privacy Policy. Both parties will comply with all applicable requirements of the Data Protection Legislation.
Intellectual Property Rights
Unless otherwise stated, the software required for the Platform and the intellectual property rights of the contents and information of and material on our Platform and Application are owned by Handicaddie. You are not entitled to copy, publish, market or promote or otherwise use the content or our brand without our express written consent.
Acceptable Use
You must not:
- Use the Platform or Application in any unlawful manner or for any unlawful purpose
- Infringe our intellectual property rights or those of any third party
- Transmit any material that is defamatory, offensive or otherwise objectionable
- Use the Platform in a way that could damage, disable, or impair our systems
- Collect or harvest any information from the Platform or attempt to decipher any transmissions
Governing Law
These Terms are governed by Northern Irish law and any legal proceedings shall be brought in the courts of Northern Ireland.
